The special feature of intellectual property rights in the field of industrial property protection lies in the monopoly position they confer. Patents and utility models, as well as trademarks and designs, give their owners the right to prohibit third parties from commercially using the protected subject matter or the trademark. This includes not only the manufacture but also the distribution, as well as the mere offering and advertising of protected objects. The handling of contentious proceedings, i.e., the out-of-court or judicial enforcement or defense of patents and utility models as well as trademark and design rights, forms a particular focus of our work.

In judicial patent disputes, there is usually a parallel patent nullity proceeding, in which we represent our clients before the Federal Patent Court (BPatG) or, on appeal, before the Federal Court of Justice (BGH). If there is a dispute based on a European patent, we represent our clients before the Unified Patent Court (UPC).
